Transgender Health Care Rights Erased Under Republicans’ 'Big

In a shocking move, Republicans' "Big Beautiful Bill" threatens transgender health care rights, leaving many wondering about the future implications.

Although the “One Big Beautiful Bill” presents itself as a thorough legislative effort, its implications for transgender health care rights are deeply concerning. The bill’s prohibition of Medicaid and ACA coverage for gender-affirming care greatly impacts approximately 276,000 transgender adults currently enrolled in Medicaid. By extending the ban on gender-affirming care beyond minors to include adults, the legislation intensifies the barriers faced by trans youth and adults seeking fundamental health services.

Under Section 44125, the bill specifically bans the use of federal funds for gender transformation procedures, such as surgeries and hormone treatments, despite these being recognized as medically necessary by leading medical institutions. This decision underscores a broader trend of discrimination against transgender individuals.

Starting in 2027, the bill’s provisions will further exacerbate health care access disparities as health plans will no longer be required to cover gender-affirming care. This change could prompt private insurers to align with the federal guidelines, leaving many without critical health insurance coverage.

Moreover, the redefinition of sex under Section 1905(kk)(3) effectively erases the recognition of transgender and nonbinary individuals from federal law. This change poses a severe threat to anti-discrimination protections, stripping away vital health care access and equality measures for the transgender community.

By dismissing the needs and rights of transgender individuals, the “One Big Beautiful Bill” not only marginalizes an already vulnerable population but also sets a concerning precedent for future legislation.
